These Terms of Service (“Terms”) govern your access to and use of the Balloontern website (the “Site”), and your purchase of any products from Balloontern. Balloontern reserves the right to update or modify these Terms at any time. Changes become effective when posted to the Site. It is your responsibility to review these Terms periodically, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
Use of the Site
You must use the Balloontern website only for lawful purposes and in accordance with these Terms. You agree not to misuse the Site or its contents. Prohibited conduct includes:
- engaging in fraudulent or illegal activities;
- attempting to gain unauthorized access to the Site or another user’s account;
- introducing viruses, malware, or other harmful code; or
- disrupting or interfering with the Site’s normal operation.
We reserve the right to terminate or restrict your access to the Site if you violate these Terms or any applicable law.
Account Creation
You may have the option to create an account for easier checkout or order tracking. If you register, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Information you provide must be accurate and up to date. You must notify us immediately of any unauthorized use of your account. Balloontern is not liable for loss or damage arising from your failure to safeguard your account information.
Product Information and Orders
We strive to keep product descriptions, images, availability, and pricing accurate and up to date; however, errors may occur. Balloontern may correct errors, inaccuracies, or omissions and change or update information at any time without prior notice, including after an order has been submitted.
If a pricing or availability error affects your order, we will contact you with the correct information and you may choose to proceed with or cancel the order. Products are subject to availability. We may limit quantities or refuse an order at our discretion. If we cancel an order—for example, because a product is unavailable or suspected to be fraudulent—we will notify you and refund any amount charged.
Pricing and Payment
Prices on the Site are listed in U.S. dollars unless otherwise noted. Customers purchasing outside the United States are responsible for currency-conversion or international-transaction fees charged by their financial institution. Payment is due when an order is placed, using a method shown at checkout.
Payments are securely processed by third-party payment providers. Balloontern does not store full credit-card numbers or sensitive payment details on its servers. By submitting payment information, you represent that you are legally authorized to use the payment method provided. We may refuse or cancel a transaction if we reasonably believe that payment or order information is unauthorized, fraudulent, unlawful, or in violation of these Terms.
Shipping and Delivery
Order shipment is subject to our Shipping Policy, which is incorporated into these Terms by reference. Title and risk of loss for products pass to the customer when the shipment is delivered to the carrier. You are responsible for applicable import duties or taxes as described in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Balloontern is not liable for delivery delays outside its reasonable control, including carrier or customs delays.

We want you to be satisfied with your purchase. Our Return Policy explains the process and conditions for returns, exchanges, and refunds. By placing an order, you acknowledge that you have read and understood that policy. Eligible returns will be refunded to the original payment method. Shipping fees may be non-refundable except where the return results from our error. Please contact us if you are unsure whether an item is eligible for return.

Although Balloontern’s primary business is direct-to-consumer retail, we welcome wholesale and bulk-purchase inquiries. These transactions may be governed by separate terms and conditions provided during the inquiry process. Contacting us about a wholesale opportunity does not guarantee approval. We reserve the right to review and approve wholesale partnerships at our discretion.

Limitation of Liability

In all cases, Balloontern’s total aggregate liability will not exceed the amount you paid to us for the product or service that is the subject of the claim. Some jurisdictions do not permit the exclusion or limitation of certain damages, so some limitations may not apply to you to the extent prohibited by law.
Indemnification
You agree to indemnify, defend, and hold harmless Balloontern and its officers, directors, employees, affiliates, and agents from claims, liabilities, damages, losses, or expenses—including reasonable attorneys’ fees—arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
Governing Law and Dispute Resolution
These Terms and disputes arising from your use of the Site or purchase of products are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law provisions. Any legal action or proceeding between you and Balloontern must be brought exclusively in the federal or state courts located in Dallas County, Texas, and you consent to personal jurisdiction and venue in those courts.
If you reside outside the United States, you agree to initiate any dispute in the courts of the United States. Notwithstanding the foregoing, Balloontern may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop infringement of intellectual-property rights or another significant breach of these Terms.
Severability
If any provision of these Terms is found unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms without affecting the validity and enforceability of the remaining provisions, which will continue in full force and effect.
Waiver
No waiver by Balloontern of a term or condition will be considered a continuing waiver of that term or a waiver of any other term. Our failure to assert a right or provision under these Terms does not constitute a waiver of that right or provision.
Entire Agreement
These Terms, together with our Privacy Policy and other policies or guidelines posted on the Site, constitute the entire agreement between you and Balloontern concerning your use of the Site and purchase of products. They supersede prior agreements or understandings, written or oral, relating to the same subject matter. Oral statements or representations do not modify these written Terms.
